1. Acceptance of Terms

By accessing or using The Dollar Vault ("Service," "we," "us," or "our"), you ("User," "you," or "your") acknowledge that you have read, understood, and agree to be bound by these Terms of Service and our Privacy Policy.

You must be at least 18 years old (or the age of majority in your jurisdiction) to use this Service. By using the Service, you represent and warrant that you meet this age requirement.

2. Service Description

The Dollar Vault is an interactive entertainment and curiosity platform that allows users to:

• Add virtual funds to their wallet via Stripe payment processing
• "Lock" virtual vaults containing messages, content, or information
• Pay $1.00 to unlock and reveal the contents of vaults created by other users
• Earn $0.90 when another user unlocks their vault (10% platform fee)

3. User Obligations & Conduct

3.1 Acceptable Use

You agree to use the Service in compliance with all applicable laws and regulations. You agree NOT to:

• Post illegal, harmful, threatening, abusive, harassing, defamatory, or offensive content
• Share content that infringes intellectual property rights, privacy, or other rights
• Use the Service for spam, phishing, fraud, or any malicious activity
• Upload malware, viruses, or any harmful code
• Attempt to hack, disrupt, or compromise the Service's security
• Impersonate others or misrepresent your affiliation
• Use automated systems (bots, scrapers) without authorization
• Create multiple accounts to manipulate the system
• Share personally identifiable information (PII) of others without consent
• Use the Service for illegal gambling, money laundering, or unlawful purposes

3.2 Content Responsibility

You are solely responsible for the content you create and lock in vaults. We do NOT pre-screen vault content. By creating a vault, you represent and warrant that:

• You own or have rights to the content
• The content complies with these Terms and applicable laws
• The content does not infringe third-party rights

4. Payments, Fees & Virtual Currency

4.1 Payment Processing

All payments are processed securely through Stripe, a third-party payment processor. By making a payment, you agree to Stripe's Terms of Service and Privacy Policy.

• Minimum purchase: $5.00 USD
• All prices are in U.S. Dollars (USD)
• Payment methods: Credit/debit cards accepted by Stripe
• We do NOT store your payment card information

4.2 Platform Fees

• Vault Opening Fee: $1.00 per vault
• Creator Earnings: $0.90 (90% of opening fee)
• Platform Fee: $0.10 (10% of opening fee) - covers hosting, payment processing, and operations

4.3 Virtual Currency & No Withdrawals

By adding funds, you acknowledge and agree that you are purchasing a non-refundable, non-withdrawable virtual currency for entertainment purposes only.

5. Intellectual Property Rights

5.1 Service Ownership

The Service, including all software, design, text, graphics, logos, and other content (excluding User-generated content), is owned by The Dollar Vault and protected by copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Service for personal, non-commercial purposes only.

5.2 User-Generated Content License

When you create a vault, you grant The Dollar Vault a worldwide, non-exclusive, royalty-free, transferable license to use, reproduce, display, and distribute your content solely for the purpose of operating the Service.

Important: Once a vault is opened, its content becomes publicly visible and viewable by all users. You cannot retract content after it has been revealed.

6. Disclaimers of Warranties

To the maximum extent permitted by law, we disclaim all warranties, including:

• Merchantability: We do not warrant that the Service is fit for any purpose
• Availability: We do not guarantee uninterrupted or error-free operation
• Accuracy: We do not verify the accuracy, quality, or legality of user content
• Security: We do not guarantee absolute security (no system is 100% secure)
• Third-Party Content: We are not responsible for user-generated vault content

6.1 Content Disclaimer

User-generated vault content does not reflect the views of The Dollar Vault. We do not endorse, support, or verify any user content. Use the Service at your own risk.

6.2 No Investment or Financial Advice

The Service is NOT an investment platform, financial service, or gambling operation. Do not use the Service for investment purposes. No content on the Service constitutes financial, legal, or professional advice.

7. Limitation of Liability

The Dollar Vault, its owners, employees, affiliates, and service providers SHALL NOT BE LIABLE for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Loss of profits, revenue, or data
• Loss of virtual funds or vault content
• Business interruption or service disruption
• Emotional distress or reputational harm
• Unauthorized access or data breaches
• Offensive, harmful, or illegal user content

7.1 Aggregate Liability Cap

Our total liability to you for any claims arising from the Service SHALL NOT EXCEED $100 USD or the amount you paid to us in the past 12 months, whichever is greater.

7.2 Jurisdictional Exceptions

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability for incidental/consequential damages. In such cases, our liability is limited to the maximum extent permitted by law.

8. Indemnification

You agree to indemnify, defend, and hold harmless The Dollar Vault, its officers, directors, employees, and affiliates from any claims, liabilities, damages, losses, or expenses (including legal fees) arising from:

• Your use or misuse of the Service
• Your violation of these Terms
• Your infringement of any third-party rights
• Content you create, upload, or share
• Your violation of applicable laws

9. Account Termination & Suspension

9.1 Our Right to Terminate

We reserve the right to suspend or terminate your access to the Service at any time, with or without cause, with or without notice, including if:

• You violate these Terms or our policies
• You engage in fraudulent, abusive, or illegal activity
• We are required to do so by law or court order
• We cease operations or discontinue the Service

9.2 Effect of Termination

9.3 Your Right to Stop Using

You may stop using the Service at any time. Simply close your browser and clear your cookies. Unused funds cannot be refunded.

10. Content Moderation & Removal

We reserve the right (but have no obligation) to monitor, review, edit, or remove any user content, including:

• Content that violates these Terms
• Content reported by users as offensive or illegal
• Content that poses legal or security risks

10.1 Reporting Violations

If you encounter content that violates these Terms, report it to: report@thedollarvault.com

Include: URL/vault ID, description of violation, and any supporting evidence. We will investigate and take appropriate action.

11. Copyright & DMCA

We respect intellectual property rights. If you believe your copyrighted work has been infringed, submit a DMCA takedown notice to:

Your notice must include: (1) Description of copyrighted work, (2) Location of infringing material, (3) Your contact information, (4) Good faith statement, (5) Accuracy statement under penalty of perjury, (6) Physical or electronic signature.

11.1 Counter-Notification

If your content was removed due to a DMCA notice and you believe it was a mistake, you may submit a counter-notification to the same email.

12. Dispute Resolution & Arbitration

12.1 Informal Resolution

Before filing a claim, you agree to contact us at legal@thedollarvault.com to attempt to resolve the dispute informally.

12.2 Arbitration Agreement (U.S. Users)

• Arbitration will be conducted under the American Arbitration Association (AAA) rules
• Arbitration location: Your county of residence or online/telephonic
• NO CLASS ACTIONS: You agree to arbitrate on an individual basis (no class arbitration)
• Each party pays their own costs unless law requires otherwise

12.3 Exceptions to Arbitration

Either party may bring claims in small claims court if they qualify.

12.4 Non-U.S. Users

Disputes will be governed by the laws of your country of residence, to the extent applicable. You may file claims in your local courts.

13. Governing Law & Jurisdiction

• For U.S. Users: These Terms are governed by the laws of the State of Delaware, USA, excluding conflict-of-law provisions.
• For EU/EEA Users: Governed by laws of your country of residence (per EU consumer protection regulations).
• For Other International Users: Governed by the laws of your country, or Delaware law if your local law does not apply.

14. Changes to These Terms

We may update these Terms from time to time. Changes will be posted on this page with a new "Last Updated" date. Material changes will be communicated via prominent notice on the Service.

Continued use after changes constitutes acceptance of the updated Terms. If you do not agree to changes, stop using the Service.

15. Severability & Waiver

If any provision of these Terms is found invalid or unenforceable, the remaining provisions will remain in full effect. Failure to enforce any provision does not constitute a waiver of that provision.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and The Dollar Vault regarding the Service, superseding any prior agreements.
